Brake Bros is fined

The company pleaded guilty at Bridgwater Magistrates Court to failing to ensure, so far as was reasonably practicable, the health, safety and welfare at work of its employees.

Action was taken following an accident in October 2004 when a warehouse worker was seriously injured when his legs were crushed between the loading bay's automatic stowing device and his electric picking truck whilst unloading a lorry.

The worker suffered two broken legs and his injuries were so serious that he was air ambulanced from the site to hospital and was unable to work for seven months.

During their investigation, officers from the Public Protection Unit at Sedgemoor District Council established that a similar accident had also occurred on the site in 2003 but that the company had still failed to take sufficient steps to prevent a recurrence.

Remedial work was however undertaken when the Council issued an Improvement Notice on the company to disable the automatic stowing device on the dock leveller.

Magistrates' fined the company £14,000 and awarded the Council full costs of £9,354.09.
