Evans & Son poultry farmer fined £5,000 for lapses

David Evans, 45, of RM & AE Evans & Son, was fined £600 by Telford Magistrates' Court for each offence, ordered to pay £3,331 in compensation to the Environment Agency (EA) and £1,000 in costs, along with a £15 victim surcharge.

Representing the EA, Jill Crawford said that Evans had been operating the poultry unit at Brunslow Farm, Lydbury North since 1997.

However, following the introduction of new regulations in 2007 for all poultry units over a threshold of 40,000 places under the Pollution, Prevention and Control (England and Wales) Regulations 2000, he had failed to apply for the appropiate permit.

In mitigation, the court heard, it was not a deliberate evasion, but a mix-up with Evans' paperwork and he had co-operated fully with the EA.
